Sewer Availability
THE FOLLOWING OUTLINES THE APPROVAL REQUIREMENTS RELATING TO SEWER AVAILABILITY FOR SUBDIVISION AND PLANNED UNIT DEVELOPMENT APPLICATIONS
Concept Plans: Prior to acceptance of a Concept Plan application, the applicant must have:
Copy of current letter indicating sewer capacity fees from Metro Water Services, Harpeth Valley Utility District, or Madison Suburban Utility District (water only). If a previously issued letter has expired or is otherwise invalid, a new letter is required. For concept plans involving existing development and where no additional flows are involved, a copy of the letter of intent that was submitted to utility with concept plan application is required.
If at the time of Commission action the applicant possesses only a "sewer availability requirement letter", the Commission may grant approval conditioned upon the applicant purchasing the required sewer capacity within the prescribed time frame. Failure to satisfy that condition automatically invalidates the Commission's preliminary approval. (Note: The above approval criteria also will apply to reapprovals of expired Concept Plans).
Development Plans: Prior to acceptance of a Development Plan Application, the applicant must have:
Copy of current letter indicating sewer capacity is available from Metro Water Services, Harpeth Valley Utility District, or Madison Utility District (water only). If a previously issued letter has expired or is otherwise invalid, a new letter is required. If sewer capacity must be purchased from Metro Water Services, the amount identified in the Water Services letter must be paid before submission of the Development Plan application. A copy of the capacity fee letter from the utility and a copy of the capacity fee receipt, or sewer availability letter, is required with development plan application. For development plans where no additional flows are involved, a letter of intent or final availability letter must be submitted to the utility, before development plan application is submitted.
- Sewer capacity fee letters are issued first by Metro Water Services and are good for 60 days from date issued.
- Any sewer capacity fees must be paid, as outlined in the sewer capacity fee letter from Metro Water Services.
- A minimum of 30% of the total sewer capacity fee must be paid within 60 days of the date of the sewer capacity fee letter to reserve sewer capacity for 1 year.
- With payment of 100% of the total sewer capacity fees, Metro Water Services reserves sewer capacity in perpetuity.
- Sewer availability letters are issued after all, or a portion of, sewer capacity fees are paid and sewer capacity is reserved.
Final Plat of Subdivision: Prior to acceptance of a Final Plat of Subdivision Application, the applicant must have:
Copy of current letter indicating sewer capacity is available from Metro Water Services, Harpeth Valley Utility District, or Madison Utility District (water only). If a previously issued letter has expired or is otherwise invalid, a new letter is required. If sewer capacity must be purchased from Metro Water Services, the amount identified in the Water Services letter must be paid before submission of the Final Plat of Subdivision application. A copy of the capacity fee letter from the utility and a copy of the capacity fee receipt, or sewer availability letter, is required with development plan application. For development plans where no additional flows are involved, a letter of intent or final availability letter must be submitted to the utility, before development plan application is submitted.

Preliminary PUD's: Prior to an approval action by the Commission, the utility district must verify that the proposal can be serviced by sanitary sewers either by the issuance of an "availability letter" or a "sewer availability requirement letter". The Commission will grant unconditional approval based on a full "availability letter". If the applicant is required to purchase sewer capacity (based on a "sewer availability requirement letter"), the Commission will approve with the condition that capacity is purchased within the time allowed by the utility and prior to adoption of the enacting ordinance by Metro Council. (Metro Council may enact an ordinance without the condition of capacity purchase being satisfied; however, it must do so as if the Commission had disapproved the proposal.)
Note: For revisions to preliminary PUDs that do not require additional Council consideration, the Commission will accept a "sewer availability requirement letter" as adequate verification from the utility to warrant a conditional approval. The condition of approval, however, will stipulate that if capacity is not purchased within the time period allowed by the utility district, the Commission’s approval is null and void. If a combined application is made to the Commission to revise a preliminary plan and grant final approval, the procedural requirements for Finals (described below) shall apply.
Final PUDs: Prior to an approval action by the Commission, the utility district must verify sewer availability. If the applicant is required to purchase capacity to obtain an "availability letter", purchase must be made and verified prior to Commission action. This procedure will also apply to any application to revise a previously approved final plan.
Note: Due both to the number of previously approved preliminary plans for which availability letters have expired and the current backlog of some utility districts in performing the necessary capacity analyses, the Commission has established a grace period for conditional approval of a final PUD application that is in conformance to the pre-existing preliminary plan. Through the February 28, 1991 meeting, the Commission will accept a "sewer availability requirement letter" as sufficient verification from the utility to warrant a conditional final PUD approval. The condition of approval will stipulate that unless sewer capacity is purchased within the time allowed by the utility, the Commission's approval will become null and void. Commencing with the March 14, 1991 agenda, the Commission will no longer grant such a conditional approval for Final PUDs.
